What are the main types of cookies?
For the purposes of this provision, two categories of cookies are identified: “technical” cookies and “profiling” cookies.
Technical cookies.
Technical cookies are those used solely to “carry out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide that service” (cf. Art. 122, paragraph 1, of the Privacy Code).
They are not used for further purposes and are normally installed directly by the owner or manager of the website. They are distinguished into navigation or session cookies, which allow normal navigation and use of the website (such as purchases or access); analytics cookies, equivalent to technical cookies if used directly by the site manager to collect information on the number of users and how they visit the site itself; functionality cookies, which allow the “user to navigate according to a series of selected characteristics and options such as language to improve the service provided to them. For these cookies, prior consent from the” user is not required.
Profiling cookies.
Profiling cookies are used to create profiles related to the user and are used to send advertising messages based on the preferences expressed by the user during web browsing. Being quite invasive in the private sphere of users, European and Italian legislation requires that the user be informed about their use and express their consent. They refer to Art. 122 of the Privacy Code where it provides that “the storage of information in the terminal equipment of a contractor or user or access to information already stored is only allowed if the contractor or user has expressed their consent after being informed with the simplified methods referred to in Article 13 Privacy Code, paragraph 3”.
